Recent Family Law, Divorce and Estates Cases

Mr. Parker successfully defended a family law Motion where the opposing party alleged parental alienation and resolved the proceeding. Also, Mr. Parker caused an Estate Trustee to be found in Contempt of Orders of the Ontario Superior Court of Justice to Pass Accounts in an Estate matter, and obtained a significant costs award for our Client. After compelling compliance and objecting to the Accounts, Mr. Parker successfully resolved the estate proceeding and caused the Estate Trustee transfer real property and to pay more than $100,000 in cash to the beneficiary.

Ms. Simone favourably responded to an Order compelling a Passing of Accounts for an Estate Trustee, and managed to reach a resolution with all involved, including the Office of The Children's Lawyer.

Legal News

The Ontario Court of Appeal gives Ontario Courts little room in family law to adjust for post separation decline in the value of family assets. See our newsletter on Serra v. Serra.

The Spousal Support Advisory Guidelines must be considered in all family law cases if put into evidence says the Ontario Court of Appeal. See our newsletter on Fisher v. Fisher. You can search the Guidelines at www.justice.gc.ca.

Toronto family law Courts are ordering retroactive support and post-application support more frequently, especially in cases where a spouse fails to disclose assets and income. For example, see our newsletter on The Marinangeli Case.
